My point is, someone with dubious intentions are more likely to prefer a means of sale that does not require a paper trail. I'm not against face to face sales, just pointing out it's easier to conduct an illegal sale in that manner.

Can I walk into Walmart with my gun and walk out with a sale?

As long as you're not a convicted felon, have restraining orders against you, and are not mentally ill, yes, you can. Provided that you filled out the proper paperwork and passed the background check.

The antis tell some lies about gun shows, face to face sales (sales of guns between private citizens who are not FFLs) and straw purchases. They call it a gun show loop hole and go so far as to say you do not need a background check to buy a gun at a gun show.

While it is true that I, who am not an FFL, can sell Stone a gun at a gun show with no background check, that is not the case with all gun show sales nor is it true to say gun shows do not require background checks. Any FFL must conduct a background check to sell someone a gun. Be they at a gun show or not.

Be we at a gun show or not, I can sell Stone a gun with no background check. We can do that sale in my front yard. Since I do not have the means to run NICS on Stone, I do not have to. I'm also not an FFL. Selling guns is not my job. In a so called face to face sale, it is Stone's job to know if he can legally purchase a gun. Now, if I know Stone is a convicted felon or otherwise restricted from owning a gun and sell him one anyway, I have committed a crime.

What are the lies? If you can sell Stone a gun at a gun show without a background check isn't it true you can sell Stone a gun at a gun show without a background check?

I think anyone can require a background check before they sell their gun to anyone else and if they can do that, they will. If they can't, they won't. Simply not requiring a background check for face to face sales doesn't mean one has to sell his gun to anyone.

One who wanted to sell his gun may find more people at a gun show that are interested in buying it then he might elsewhere. If he doesn't make the mistake of becoming a dealer why would he have to do a background check? Can some gun shows dissallow face to face sales and require all sellers to be FFL?

I think the "lies" are that the anti-gun crowd tries to make gun shows out to be this great lawless free-for-all where any criminal can just walk in and buy a gun. This really isn't the case. The majority of people that purchase space at these shows are FFL holders, licensed dealers that are required to run a background check when selling a gun. Some gun shows will require all exhibitors to have an FFL, but not all. There are some gun shows that allow anyone wanting to sell off a collection or whatever to purchase space.

It is these sellers that aren't required to run a background check on buyers.

And, yes, anyone can require a background check when doing a face to face sale. All that would entail is both buyer and seller going to a gun store, paying around $30, and have the store run an instant check on the buyer. This is not required by law though.

I'm thinking these tactics by the anti-gun crowd would be easily disproved because this isn't the case. Making claims such as they apparently make should, therefore, be unbenificial to them. However, using this crowd's mistaken beliefs as proof that the anti-gun crowd is a bunch of whackos and therefore mentions of any gun control is equally whacko, may be benificial to the pro-gun lobbyists. I think there is a more sane middle-ground crowd with substantial numbers. Any idea if my last thought is somewhat true or is the anti-gun, as in no guns at all, crowd really a force? I don't really know as I've never felt threatened by too few or too many guns and so never got too involved either way.

Actually, one of the reasons I don't really like Hillary Clinton is a speech she gave in Florida where she claimed guns are responsible for 19* children's deaths every day. A simple check showed this number to be accurate only if manipulaated beyomnd the actual impression of her comments. The use of this statistic didn't give more credence to her crowd-pandering, for me, so I would think it wouldn't give more to any ability she might have to make "gunless America" laws.

Certinly the promoters of gun shows, in many cases I'm sure, are hoping to make a little profit from thier shows much like other shows and some feel the appeal of profit means allowing cash payment to be the determining factor. Some may feel cash alone is not enough and some feel FFL only is the way to go.

* Something like that. The number basically used the assumption that we are all somebody's child.

Im not so sure that a background check would be that easy. Unless the individual was going to purchase a gun from the gun dealer who has the FFL, the ATF may frown on such a background check.
